Child labor slave - Reduce the worker to a condition analogous to slavery through forced labor, journey exhaustive or degrading working conditions (Article 149 of the Penal Code), with the aggravating circumstance of whether the child or adolescent (§ 2, itemI). The aggravating factor was introduced by Law 10,803 of 11 December 2003 andincreases the penalty in half;
Maltreatment (Article 136 of the Penal Code), applicable to minor crime - Exposing thedanger to life or health of a child or adolescent under his authority, custody or supervision, subjecting it to work excessive or inappropriate. If the person is under 14, there is the aggravating factor of § 3, introduced by the ECA (Law 8.069/90), whichincreases the penalty by another third.
Exploitation of prostitution of minors - The exploitation of child prostitution, consideredby the ILO as one of the worst forms of child labor is a crime under Article 244-A of the Children and Adolescents.
Child pornography - Crime under Articles 240 and 241 of the ECA.
Sale or trafficking of children - is a crime under Article 239 of the ECA.
Portugal
In Portugal, child labor is considered a grave offense to the integrity of a child andseverely punished, with imprisonment and huge fines. Article 152 of the Portuguese Penal Code defines the specific cases where child labor is now a crime - abuse of minors in work activities involving dangerous, inhumane or prohibited (item 2) oroverwork (item 3).
Cases of child labor in Portugal are residual, registering an average annual basis only 1or 2 cases.
