Legislation on child labor

Brazil
In Brazil, the 1988 Constitution (article 7, XXXIII) admits the work, in general, from the age of 16, except in cases of night work, dangerous or unhealthy, in which the minimum age is given at age 18. The Constitution acknowledges, too, work from 14 years (art. 227, § 3, I), but only as an apprentice (article 7, XXXIII).
The CLT (Consolidation of Labor Laws), in addition, warrants to adolescent workersbetween 14 and 18 years a number of special protections, detailed in Chapter IV(articles 402-441). Among them, the prohibition of work in places prejudicial to theirtraining, their physical, mental, moral and social, at times and places that do not allowschool attendance (art. 403, § only). CLT grants, too, the working student under 18, the right to make your holiday coincide with school holidays (art. 136, § 2).

International Labour Organization

Convention No. 138 of the International Labour Organization (ILO), 1973, in Article 2,Item 3, sets the minimum age recommended for the general working age of 16 years.
In the case of member countries considered very poor, the Convention recognizes that it is initially set a minimum age of 14 years to work.
The same convention recommends a minimum age of 18 years for work that mayendanger the health, safety or morals of a minor, and suggests a minimum age from 16years to work that does not endanger the young for any of these reasons provided thatthe young receive adequate instruction or vocational training.
The Convention also recognizes, by exception, the light work in the age group between 13 and 15 years, provided they do not endanger the health or development of the young, going to school or of their participation in vocational orientation or training programs, the competent authority should specify the maximum time permitted activities and daily work.

UNICEF

According to UNICEF (United Nations Fund for Children), child labor is defined as anyform of labor under 12 years of age, in any economic activities; any work between 12 and 14 years other than light work; all the type of work under 18 framed by the ILO in the "worst forms of child labor."
For purposes of field research, UNICEF defines child labor as an indicator of the percentage of children 5-15 years involved in child labor. The definition of UNICEF, for research purposes, is under the following classification:
Working children aged 5 to 11 years: work performed during the week preceding the survey for at least one hour of economic activity or domestic servant of 28 hours /housework that week;
Work for youth 12 to 14 years by at least 14 hours of economic activity or 42 hours ofeconomic activity and domestic work combined that week.

Worst forms of child labor

While child labor as a whole, is seen as inadequate and inappropriate for minors below the legal minimum age, the United Nations consider some forms of child labor asparticularly harmful and cruel and should be tackled with priority.
Convention No. 182, 1999, applies in this case all children under 18 years, ranks as the worst forms of child labor, slave labor or semi-slave (in a condition analogous toslavery), the work involved in sale and trafficking of children, debt bondage, the use ofchildren or adolescents in armed conflict, prostitution and child pornography, the use of children for illicit activities, such as the production and trafficking of drugs and the workthat may harm health, safety or morals of the child.
In Brazil, some of the particularly harmful forms of child labor are working in cane fields,in coal mines in funilarias in cutlery (where they manufacture cutting tools), and in metallurgy from the hot ovens, among others.
